Italian to English Law/Patents Law (general)
E CON L'INTERVENTO DEL "PUBBLICO MINISTERO" nella persona del "Procuratore della Repubblica" presso il Tribunale di ____" (USA English)
Subject: Dissolution of Marriage

I've done some research but I seem to be quite confused about these two terms...some help would be much appreciated, thanks!

Hi, "PUBLIC PROSECUTER, in the person of the State's/District's Attorney (for USA).
Any feedback would be appreciated, thanks!

Unexpected, but also true in Spain the Public Prosecutor doubles as a Queen's Proctor-type offiicial who checks the arrangements for children and, in the event of fraud or duress, can stop the decree nisi being made absolute. No need for haste in looking at my first reference:

Unexpected but true Italy is full of the unexpected. If the divorce goes before a judge in a public hearing due to some caveat, then it would be normal for the prosecutor's office to have someone in the courtroom, in Italy. Most divorces are settled in chambers with the parties and their respective counsel.

I wouldn't have expected the public prosecutor to be involved in a divorce.

(AmE) PUBLIC OFFICER/Proctor of the Italian Republic

Troube with Public Prosecutor for the 2nd part is that it pertains more to crime than to ratification of a divorce.

Example sentence:

Proctor: (formerly) an agent, esp one engaged to conduct another's case in a court

PUBLIC PROSECUTOR/ DEPUTY PROSECUTOR OF THE ITALIAN REPUBLIC

a PUBLIC PROSECUTOR is always there during a trial, (like the devil's advocate) AND is in fact a magistrate

the deputy prosecutor is the magistrate in Office, belonging to the larger body of the ITALIAN PUBLIC PROSECUTOR'S OFFICE (PROCURA DELLA REPUBBLICA)

disagree Inter-Tra : Deputy prosecutor è sostituto procuratore. The public prosecutor is a career magistrate

quando il magistrato è in aula con funzioni di pubblico ministero, è il "public prosecutor". quando esce dall'aula torna a essere un career magistrate

PROSECUTOR MAGISTRATE (in the person of) the Public Prosecuter

Prosecutions in Italy are conducted by the Public Prosecutors' Office. Both judges and prosecutors are considered magistrates under the Constitution

See II link
Magistrates who play the role of the public prosecutors in the trials are:

>Chief prosecutors of first instance (procuratore della Repubblica presso il Tribunale) and their deputies (sostituti procuratori)
>Chief prosecutors of second instance (procuratore generale presso la Corte d’appello) and their deputies (sostituti procuratori generali)
>Attorney general for the supreme court (procuratore generale presso la Corte di cassazione) and his or her deputies (sostituti procuratori generali).

In Italy, the role of public prosecutor is played by career magistrates, who exercise their functions under the supervision of the chief of their bureau. This operates as a kind of hierarchy that applies only to the public prosecutors’ offices.
