Najzad, unutar ovako postavljenog opšteg okvira, pred ustavotvorcem i zakonodavcem se nameće rešavanje još nekoliko povezanih pitanja:
Najpre, kako će tretirati odluke međunarodnih sudova (i kojih), a potom, kako će rešiti jedan od osnovnih preduslova za podizanje sudske prakse na određeni nivo obaveznosti, a to je njena dostupnost. Naime, ako se ustavotvorac odluči da sudsku praksu u određenom stepenu učini, ako ne direktnim izvorom prava, a ono makar sredstvom kojim se sudija mora rukovoditi u njegovom tumačenju i primeni, mora stvoriti preduslove da sudska praksa bude lako dostupna ne samo nosiocima pravosudnih funkcija, već i ostalim učesnicima u postupku

the Constitution
change the style of writing - instead of the literal "creator of the Constitution" just personify "the Constitution":
... it the Constitution decides to make jurisprudence a source of law ...
or maybe better, make it impersonal
... if the Constitution is made/written/drafted in a way to
you can also simply stay close to the style of the ST ...
anyway "Ustavotvorac" is just a figure of speech - in places where for real ONE person makes the fundamental rules, there is no need for any "Constitution" ...

Prilično sam siguran da je "ustavotvorac" ovdje sinegdoha jer u modernim društvima pojedinci obično ne kreiraju ustave sami. U svakom slučaju, ponuđeno je samo jedno od više mogućih rješenja.
