"Si le principe [du contradictoire/ droits de la défense] n'est pas exprimé dans un texte c'est sans doute qu'il est vu comme un principe processuel de droit naturel, une règle inhérente à toute procédure, une exigence d'essence supérieure."

What does 'essence' mean here? 'A requirement for a higher/superior ?XXXX?'

essence: in essence rather than in petrol or 'power' - better not simply ignore.

Karen V-J 'beat' me to the overriding, but see the web ref.

Exigence > could also be a standard e.g. of proof.
