Gemäss Art. 47 Ziff. 7 Dekret über die Arbeitsgerichte kann gegen ein Urteil des Arbeitsgerichtes Nichtigkeitsklage eingereicht werden, wenn das Urteil klares Recht verletzt, indem es mit einer bestimmten Gesetzesvorschrift des Zivil- oder Prozessrechts in Widerspruch steht oder sich auf eine offenbar unrichtige Akten- oder Beweiswürdigung gründet. Klares Recht verletzt eine Rechtsanwendung, die
schlechterdings unhaltbar ist. Ist sie vertretbar, widersteht sie der Anfechtung, gleichgültig, ob der oberinstanzliche Richter, könnte er (wie bei der Appellation) frei entscheiden, ihr folgen würde oder nicht. Die Nichtigkeitsklage bezweckt also, handgreifliche „Betriebsunfälle“ bei jenen Urteilen zu beheben, die keiner Appellation unterliegen1.

Klares Recht ist eine Norm, welche nicht verschieden ausgelegt werden
kann. Sind bei sorgfältiger Prüfung verschiedene Auslegungen nach Wortlaut oder Sinn möglich, versagt die Anfechtung durch die Nichtigkeitsklage. Die Entscheidung darüber, welchen von beiden der Vorzug gebührt, liesse sich nur bei freier Kognition, wie sie der
Appellation eigen ist, erreichen.
