Sergio Thks your explanation, its what we call in english "A dirty B/L", now I think about it, not so important for the Road Haulage B/L which acts more as a receipt for goods (with notations) - unlike the Maritime B/L which is a negotiable document, and if any comment/notation placed on it, the shipper would not be able to negotiate the Letter of Credit - as nearly all L/C s demand an absolute "clean" B/L. You got it Mark! I was master mariner with the UK merchant Navy so Ive done a few of those in my time. In practice even if the Mates receipts were claused - very rarely would the BL be claused otherwise the shipper would not be able to negotiate his L/C , which would have commercial impacts for both shipper and shipping company, invariably as a compromise a back -letter would be issued (hopefully in good faith as legally it was worthless!) |
