Όπως τονίζεται στην ίδια ανακοίνωση, η εταιρεία αντικατέστησε τον κ. ΧΧΧ με άλλον αναλογιστή, κατέθεσε εναντίον του μήνυση για απόπειρα εκβιάσεως σε βαθμό κακουργήματος και στην συνέχεια κατήγγειλε την σύμβαση εργασίας του ως διευθυντή της αναλογιστικής υπηρεσίας.
Πάντα κατά την εταιρεία ΖΖΖ, μετά τις ενέργειες αυτές ο κ. ΧΧΧ "προέβη στην διάδοση ανυπόστατων σε βάρος της εταιρείας καταγγελιών προς πάσα κατεύθυνση", ενώ σε ό,τι αφορά την οικονομική θέση της εταιρείας, επισημαίνεται ότι "οι οικονομικές καταστάσεις της 31/12/2006 δημοσιεύθηκαν, αφού προηγουμένως είχαν ελεγχθεί και πιστοποιηθεί ως αληθείς και ακριβείς από τον αρμόδιο Ορκωτό Ελεγκτή".
Πάντα κατά την εταιρεία ΖΖΖ, μετά τις ενέργειες αυτές ο κ. "The common law divided participants in a felony into four basic categories: (1) first-degree principals, those who actually committed the crime in question; (2) second-degree principals, aiders and abettors present at the scene of the crime; (3) accessories before the fact, aiders and abettors who helped the principal before the basic criminal event took place; and (4) accessories after the fact, persons who helped the principal after the basic criminal event took place. In the course of the 20th century, however, American jurisdictions eliminated the distinction among the first three categories." Gonzales v. Duenas-Alvarez, 549 U.S. __ (2007) (citations omitted).
