The French noun "le recueil" would be best expressed by a verb in English. I read "recueillir" to mean "to obtain". It is not quite the same as receiving, which is passive. "Recueil" here seems to be actively seeking to obtain, to ensure that the necessary guarantees have been taken out.

the statements made, etc...;
the guarantees set out herein have been obtained."

"Effectif" means that they actually have to be obtained, not just promised or sougt, but obtained/taken out. "Warranty" may be a more appropriate term for "garantie" here, but that would depend on further context and is not the poitn being raised here.

what the Lender is saying is: we will not put the amount of the loan in your account until/unless we have in our own hands (en possession effective) the collaterals we asked for (which is here in the form of "des garanties"),

neutral  Daryo: whatever "receuil/lir" on its own would suggest, in actual facts it's not up to the Bank to actively chase these "garanties" - if the Borrower wants the loan, he will have to do the "active" part: get the collaterals and hand them to the lending Bank...

  -> Of course. The lender has to seek and obtain the gaurantees etc. By the use of the passive voice, I'm indicating that they have to have been obtained.
