По общему правилу он (срок давности) начинает течь с момента, когда лицо узнало или должно было узнать о нарушении права (п. 1 ст. 180 ГК). Определение на практике момента, с которого лицо узнало о нарушении своего права, как правило, осуществляется в зависимости от конкретных обстоятельств и зачастую является весьма непростым.

"мешает" оборот "на практике":

Generally, a point in time when a person has learned about a violation of his/her right is determined [in practice]depending on particular circumstances, which is not always easy...

Или лучше следовать русскоязычной конструкции - Determination of a point in time when a person has learned about a violation of his/her right is usually carried out depending on particular circumstances and is not always easy...

Determination of - это не калька с русского?

"Not straightforward" sounds more legalese than "not easy."

Первый вариант лучше, но концовку я бы переделала. "which is not always easy" -непонятно, к чему относится- к периоду времени?

Первый вариант лучше, is determined потому что Определение осуществляется на английском= is determined

когда лицо узнало или должно было узнать - you wrote "a person has learned about" - а где вторая часть?

Determination of - это не калька с русского? IMHO, definitely not.
