French term or phrase: Condition suspensive
I realise this has been asked and answered before. My question really relates to the syntax of a paragraph containing this expression. However, maybe there is an alternative for "condition suspensive" which would clarify things.

"ARTICLE 25 - CAPITAUX PROPRES INFERIEURS A LA MOITIE DU CAPITAL SOCIAL
...
La réduction du capital à un montant inférieur au minimum légal ne peut être décidée que sous la condition suspensive d'une augmentation de capital destinée à amener celui-ci au moins à ce montant minimum"

"ARTICLE 25 – EQUITY BELOW HALF THE SHARE CAPITAL
A resolution to reduce the capital to an amount below the legal minimum shall only be passed on the condition precedent of an increase in capital intended to increase this to the legal minimum."

I don't like the flow of my paragraph and would be delighted if someone told me I had got it all wrong because...

neutral  writeaway: asker wanted proofreading of the entire paragraph. And the answer of the term posted is already in the glossary more than once. Scotland hin, Scotland her.....

  -> 1. Proofreading does not include editing, checking or review. 2. The entire paragraph is another matter 3. the Scottish variation of this term is nowhere flagged in any glossary entry & 4. it's disrespectful to write off Scotland as a legal jurisdiction.

Explanation:
Suggested rendering, with and without the term "condition precedent" :

Reducing the capital to an amount lower than the statutory minimum is conditional upon the capital being increased (having being increased : in order to bring out the fact that it must precede) to an amount at least equal to the minimum amount.

Subject to the condition precedent that the capital be increased to an amount that is at least equal to the statutory minimum, the capital may be reduced to an amount lower than the statutory minimum.

  -> what are you on about now?? anyway, question was closed before you popped up and your answer is the same as all theses entries. What about the BWI? Are you ignoring them? /ambling refs or twisted convoluted answers- don't see the difference
