Draudu pielietošana (metum fecit – lat.) ietvēra viltu jeb tīšu kaitējumu (dolo teneri – lat.) (D 4.2.14.13) un par to būtisku pazīmi atzina cietušajam nodarītu zaudējumu pastāvēšanu („...dēļ draudu lietā ceļamā prasījuma [specifiskās] dabas, kas pieprasa, lai zaudējumi būtu nodarīti (...propter naturam metus causa actionis quae damnum exigit – lat.)”) (D 4.2.12.2) – tā piemēram, ja kāds bija pret oponentu aizsargāts ar pastāvīgu ierunu (exceptione...perpetua – lat.), un vienlaicīgi piespieda viņu sevi ar akceptilāciju no saistības atbrīvot, draudu gadījumam paredzētās tiesību normas piemērot nevarēja, jo piespiestais faktiski neko zaudējis nebija (D 4.2.14 pr.) – saistība tāpat būtu izbeigusies, arī bez akceptilācijas.
