"At this point, it should be recalled that in Saunders v Vautier it was said by Lord Langdale MR that a sole, absolutely entitled beneficiary may require payment by the trustee ‘the moment he is competent to give a discharge’.10 A ‘discharge’ is a receipt for the funds paid over and an acknowledgement that the accounts are settled."

"(7) Sale of Property where a patient is co-owner
If the legal estate in land held on trust is vested either solely or jointly in a person who
is incapable by reason of mental disorder of exercising his functions as trustee, before
the legal estate can be dealt with under the trust of land, or under the powers vested in
the trustees of land he/she must be replaced as trustee or otherwise discharged from
the trust, unless the sale is to the other co-owner(s).
Consequently, in such circumstances, where the beneficial interest in the proceeds of
sale is held by the co-owners as joint tenants or as tenants in common, before the
property can be sold the patient will have to be removed from t5he position of
trustee of land. In such a case it is usually necessary for a new trustee to be appointed
in place of the patient, even where there may be two other continuing trustees. There
must be at least two trustees (or a trust corporation) to give a discharge for the
purchase money."
