A company that has a procurement contract with a public body could use that contract as collateral to obtain financing from a bank.
A copy of the procurement contract that includes an appropriate special mention can be used as "proof of entitlement" i.e. entitlement to receive payments on the basis of the contract.
The right to receive the payments becomes incorporated in the document (==> cette pièce "formera titre") - i.e. who holds the document can claim the payments. That copy is worth as much as the value of the procurement contract to whoever holds it, so can be used as collateral.

Cession de créances

Le titulaire et tout sous-traitant payé directement peuvent céder ou nantir à des établissements de crédit, par exemple, leur créance dans les conditions prévues aux articles 106, 107, 108, 109, 110 du code des marchés publics.

A cette fin, le pouvoir adjudicateur remet au titulaire et à tout sous-traitant payé directement soit une copie de l’original du marché, de l’avenant ou de l’acte spécial de sous-traitance indiquant que cette pièce est délivrée en unique exemplaire, soit un certificat de cessibilité conforme à un modèle défini par arrêté du ministre chargé de l’économie.

Ce dispositif vise à éviter que la même créance soit cédée plusieurs fois ou qu’une entreprise cède la créance d’une autre. Il importe donc tout particulièrement, pour que ce dispositif fonctionne bien, que le pouvoir adjudicateur opère un suivi de chaque exemplaire unique ou certificat de cessibilité délivré au titre du marché lorsque la part respective des entreprises (titulaire, sous-traitants) est modifiée en cours de contrat.
