Dutch courts have interpreted restrictively what constitutes public policy for the purposes of article V(2)(b). Public policy has thereby been interpreted as international public policy, which is narrower than national public policy. The Supreme Court has held that in examining whether an award is contrary to public policy or not, the enforcing judge is bound by the facts as established by the arbitral tribunal in its award. However, the judge can depart from the established facts only if he finds that the arbitrators were so negligent in establishing those facts that enforcement would be contrary to public policy .

"Art. 6 WCH bepaalt dat, in afwijking van het in art. 5 bepaalde, erkenning aan een buiten Nederland gesloten huwelijk wordt onthouden indien die erkenning onverenigbaar zou zijn met de openbare orde. Ook hier geldt, dat het begrip "openbare orde" zeer restrictief moet worden toegepast."

Het gaat hier om Artikel V, (2) (b) van het Verdrag van New York (Verdrag over de erkenning en tenuitvoerlegging van buitenlandse scheidsrechterlijke uitspraken), dat volgens de vertaling gehanteerd door het T.M.C. Asser Instituut, luidt:
b) dat de erkenning of tenuitvoerlegging van de uitspraak in strijd zou zijn met de openbare orde van dat land.
