This is from a description of a mediation process, document is from Spain. The phrase appears several times in succession:

A estos efectos, se considerará que el Mediador no ha conocido de un caso si el Mediador aprecia temeridad en la petición de la Mediación, volviendo a ser elegible en el siguiente sorteo de designación de Mediador.

Sin perjuicio de lo dispuesto en el apartado, la revision prima facie de la solicitud de Mediación para la apreciación de la existencia de temeridad devengará unos honorarios iniciales a favor del Mediador.

En caso de no apreciar temeridad, los honorarios iniciales quedarán subsumidos en los del procedimiento de Mediación subsiguiente.

Is the Mediator evaluating for recklessness in request for mediation? Is there a legal term for this?

Thanks, all- I decided to phrase it using eligible / ineligible. The context and the mediation process referenced were too informal to use any of the suggested answers.

The reason I believe this is relevant is because as it states, the mediator were to evaluate the existence of malicious prosecution OR frivolous litigation OR abuse of process, then the professional fees due to the mediator will then be subsumed in the subsequent mediation proceeding, implying that if the determination is made that there was indeed malicious prosecution OR frivolous litigation OR abuse of process, the party responsible may have to pay such fees.

Article 87
1. A decision as to costs shall be given in the final judgment or in the order which

Where there are several unsuccessful parties the General Court shall decide how the costs are to be shared.
3. Where each party succeeds on some and fails on other heads, or where the
