It appears in a prohibition clause to prevent concurrence of products, in a distribution contract. Here it goes:

"El incumplimiento de la obligación de no concurrencia generará al DISTRIBUIDOR la obligación de pago al CONCEDENTE de una cuantía equivalente al ***importe medio anual*** del margen bruto del DISTRIBUIDOR durante los cinco (5) años anteriores a la extinción del contrato...."
