In a doc about financing a wind farm, explaining the financing structure;
un mantat hypothéquer sur les baux emphytéotiques pour le solde du montant de la Dette Senior

Looking on google, i can't find any translation, but it seems to be linked to a building loan, and seems to dfferentiate itself from a 'promesse hypothéquer' in that it requires the borrower to pay upfront fees...

I was thinking as translating it simply as 'mortgage' unless anyone has any better ideas?!!

For info: Mandat hypothécer seems to be another possible way of saying mantat hypothécaire, as I have now come across it three times in the text - definately not a spelling mistake!

I don't know how you would say this in the UK, but in the US I might have to be circuitous and say something like a mortgage (or a collateralized loan)on the emphyteutic lease improvements for the balance of the amount of the senior debt.

Need more context to see if that fits right.

the "mandat" "contract of agency" inter alia, really seems to be inherent in the word...

Mandat hypothécaire I would suspect a spelling problem in the source text. Spelling the term as above makes a lot more sense. Checking with the client may be an option.

Un emprunteur peut proposer à son organisme bancaire de lui donner mandat pour lui permettre de prendre hypothèque si cela se justifie dans le futur, ce qui lui évite les frais d'acte notarié de crédit (2 à 3 % de la valeur du bien pour les crédits dont le montant se situe dans la moyenne nationale). A borrower may propose to his bank to give him a mandate to enable it to take out a mortgage if justified in the future, thus avoiding the cost of notarial credit (2 to 3% of the value of the property for appropriations, the amount is within the national average).

Le notaire sera chargé de rédiger le mandat hypothécaire mais la provision qu'il demandera sera nettement moindre (pour un crédit de 100.000 € : 570 € contre 2.800 €). The notary will draft the mandate but the mortgage provision that will require significantly less (for a loan of 100,000 €: 570 € against € 2,800).

La différence se justifie par l'absence de prise d'inscription au bureau des hypothèques, par le coût très faible de la formalité de l'enregistrement de l'acte notarié (25 €) et par des honoraires notariaux réduits.
