Dispozitiile art. 26 alin. 1 din Decizia-cadru a Consiliului Uniunii Europene din 13 iunie 2002 privind mandatul european de arestare si procedurile de predare intre statele membre stipuleaza ca statul membru emitent computa din durata totala a privarii de libertate care ar trebui executata in statul membru emitent toate perioadele de detentie (fara a se distinge intre diferitele tipuri de detentie) ce au rezultat din executarea unui mandat european de arestare.


Article 26

Deduction of the period of detention served in the executing Member State

1. The issuing Member State shall deduct all periods of detention arising from the execution of a European arrest warrant from the total period of detention to be served in the issuing Member State as a result of a custodial sentence or detention order being passed.
