After resolving the discussion on difference between "kuratela" and "probation", the effort to find an adequate term for "kuratela" led me to accept the general "care" as the one. IMHO, the Slovak legislator adopted "kuratela" only in relation to "kurátor" as the person executing the law as a specific category of "social worker", "sociálny pracovník". Thank you a lot though to have ascertained differences across EU :) 3 KudoZ points were awarded for this answer
Personally I don't like 'social custody' - maybe in the US it is different, and I am not saying that it is wrong! I can only really speak from a UK perspective (or, more precisely, England and Wales - I think Scotland and Northern Ireland are slightly different)

I think the 'Social Worker' bit was a bit of a red herring on my part - sorry - Socialni Kurátor is 'social worker', but IMO the WHOLE THING is 'Social Services' - in the UK this covers a wide area. If you look at the Salford link I posted below, or this one taken at random http://www3.hants.gov.uk/health you can see that 'Social Care and Health' covers adults and children under separate subdepartments. Then there is the probation service, which also covers 'Sociálna kuratela plnoletých fyzických osôb' - so in the UK at least there is not ONE SINGLE entity that covers everything. If you google 305/2005 Coll. you will find that it is translated variously as 'Social and Legal Protection of Children and on Social Legal Guardianship' or 'socio-legal protection of children and social curatorship' (Council of Europe) - personally I would choose the former as 'curatorship' is certainly not used in this context in the UK.

you may be right in that there is no right answer to this. The "sociálna kuratela" bit is not easy to translate. But this whole phrase is also a title of a Slovak act: Zákon o sociálnoprávnej ochrane detí a o sociálnej kuratele http://www.uprevuca.sk/download/na_stiahnutie/zakony/2005c13... This is the Slovak concept. So would you translate this the title of this act as - Act on Social/children's Services and Social Worker (Act on Social/children's Services and Social Worker)?
social probation nemusí byť to isté ako probation. Ako vidno z toho zákona "sociálna kuratela" je niečo širšie, je to súbor rôznych opatrení týkajúcich sa rôznych oblastí.

Podľa odst. 3 citovaného ustanovenia orgán SPOD a SK podáva súdu správu o zistených bytových, sociálnych a rodinných pomeroch maloletého dieťaťa.

probátor - organizovanie a výkon dohľadu nad obvineným, kontrola výkonu trestu nespojeného s odňatím slobody, dohľad na správanie obvineného v priebehu skúšobnej doby a napomáhanie obvinenému, aby viedol riadny život. Pojem probácia je odvodený z latinského probare = skúšanie, overovanie. Probácia predstavuje spôsob dohľadu nad odsúdenými. Môžeme ju považovať za druh trestu (skúšku), ktorý sa však vykonáva na slobode. Podľa definície OSN „probácia je metódou zaobchádzania s vybranou skupinou páchateľov v rámci podmienečne odloženého trestu, keď je uložený dohľad, a to spolu s poskytovaním individuálneho poradenstva a ďalších podporných podmienok“. Cieľom probačnej činnosti je motivovať obvineného, aby sa sám aktívne zapojil do odstraňovania príčin a riešenia následkov vlastnej trestnej činnosti.
V prípade tejto otázky ide jasne o kuratelu a nie o probáciu.

Explanation: There is no 'correct answer' to this one as each English-speaking country has different rules and nomenclatures. Even in the UK it varies from place to place - usually something like 'Social services' and 'Children's services' (where 'kurátor' is best translated as a 'social worker' - a 'Children's guardian' is 'kolizná opatrovnička'). Do not get confused between the Slovak 'sociálny pracovník' and the (British) English 'social worker' - they carry out very different work.
