The Corte di Cassazione is not a Court of Appeal! Legally speaking this is incorrect. A Court of Appeal is not the highest Court of the land, this is (in civil, comercial and criminal matters) the Supreme Court (e.g. US, or Corte di Cassazione, Cour de Cassation, in Italy and France, respectively). Moreover, there are other important beyond hierarchy. A Court of Appeal may reassess the facts of the case, whereas the Corte di Cassazione cannot do that and is only concerned with points of law (that's why is also called Corte di legittimità, in contrast to Corte di merito - Appeal Court). My 2 cents.
