Peer comment(s):

agree Lilma Schimmel (X) : Not sure about period... maybe it could be "agreement"

neutral Aoife Kennedy : In this case it seems we're talking about a document granting custody, not the duration of the custody.

disagree Wm Steinmetz (X) : Here, "termo" is an agreement or a binding instrument. Term (meaning period) is usually expressed as "prazo" in legal Portuguese.

Waiver of Child Custody

Se a mãe está abdicando do pátrio poder em caráter irrevogável e irretratável, então trata-se de um "waiver of such rights/powers". Eu diria que a expressão "termo" no caso é irrelevante, salvo melhor juízo.

Note a explicação da Wikipedia:

• Waiver

A waiver is the ***voluntary relinquishment or surrender of some known right or privilege***. While a waiver is ***often in writing***, sometimes a person's actions can act as a waiver. An example of a written waiver is a disclaimer, which becomes a waiver when accepted. Other names for waivers are exculpatory clauses, releases, or hold harmless clauses.

cheers, mate
neutral Wm Steinmetz (X) : This term is not "wrong," but it does not tell the whole story in native English. Especially in legal translation, we cannot define words individually and out of context. A commonly used term in this specific context is "custody agreement."

Well, agreement if the parties were trying to settle something as to the custody, but in this case the mother has abdicated her rights.
