French to English Law/Patents Law (general)
Again this is from a commentary on an EC regulation regarding small claims procedures - the text says - "la transaction devrait éteindre la procédure sur les demandes de faible importance en cours afin d’en préserver tout l’intérêt." (no other context, the next point is about a different topic).

I assume this is again some standard phrase in law but haven't found it in the dicos or glossary or google. Whose interest is being preserved by extinguishing the claim?

"en"= de la proc�dure - l'int�r�t= the benefits/usefulness (of the procedure) - and you're right to use "extinguish"

But I found "to extinguish a claim", or a procedure in the English version of the main EC Regulation on which this text is a commentary. Collins/Robert also gives for Jur. sense of �teindre = extinguish. I would be just as happy with put an end to!

the [legal] transaction should obviate proceedings on current small claims by preserving the interests being acted upon therein...

in other words: you don't go to court..if you do the legal transaction they refer to, an actual court appearance is not necessary and safeguards the interest being acted upon in the claim..

ie solves the problem...

it does not mean extinguish..it means that a court proceeding is not longer necessary because the transaction in question safeguards the interest and resolves the claim..

disagree Christopher RH : it is NOT a "transaction" in English but an out-of-court settlement, the whole point of a settlement being to extinguish the claim in a definitive manner, not merely render court proceedings unnecessary.

without context, this is a safe generic way to express it..yes, I have left out the "tout"...

Interest means appeal or attractiveness, not standing, here.

So: 'the settlement would have to extinguish the small-claims proceedings pending in order to retain its full pulling power'

Unless the settlement wipes out the small claims, there is no \'interest\' = appeal in such a settlement.

agree df49f (X) : oui c'est bien le sens: il s'agit de préserver l'intérêt (i.e. the usefulness/benefits) de la procédure ("en"= la procédure) et non pas les intérêts de qui que ce soit - and yes "extinguish a claim" is correct ...n'en déplaise à quiconque!

No. Extinguish - as in expunge. But the question is about the interest.
agree Christopher RH : Absolutely agreed: "une transaction", an out-of-court settlement, is only useful if it "wipes out" the claim entirely. It is only if it extinguishes the lawsuit that there is any interest in settling out of court.
