: that's the translation for "utuživa" // there is nothing conditional/hypothetical in "utužena" - legal has been taken, it's not just a possibility.

: ambiguous - "claimed" doesn't necessarily mean that the matter ended up in a court, that a legal action was taken. It might mean just few nasty letters, to scare the debtor into paying before any legal action is taken.
