I am translating an Agreement from Portuguese to English, it is a Purchase and Selling Agreement of Properties and this term come out and I am facing problems to find a correspondent in english, the sentence is:

A cindibilidade consiste na possibilidade e fazer apenas o registro de parte dos objetos constantes do título seja porque existe uma nulidade parcial que permite a separação, ou porque houve pedido expresso da parte interessada, isto é, é possível a separação do título (o que comporta registro), colocando de lado o que não pode ser registrado.

A partition is a term used in the law of real property to describe an act, by a court order or otherwise, to divide up a concurrent estate into separate portions representing the proportionate interests of the tenants. Under the common law, any tenant who owns an undivided concurrent interest in land can seek such a division. principle of separation/division

I have not found an exact equivalent in English. However, the concept seems fairly clear from Internet research. It derives from Brazilian Federal Law no. 6.015/73. The "matrícula" (title) of a property can be split into two or more titles if necessary, to overcome a restriction on transferring the original title entirely, at the discretion of the registrar. An example I saw: an heir cannot afford to pay the taxes on transfer of a title deed that includes 10 houses. He can only afford the tax on 3 of them. The registrar can create a new title for the three properties and transfer them.

The regsitration needs to go in since the phrase rises the spectre of severability in Anglo-Am Eng. Common Law and meaning 'the blue pencil test', namely striking invalid clauses from otherwise valid contracts.

Exemption clauses - clauses in a contract that try to restrict the liability of the party that writes them. These are split into exclusion clauses that try to exclude liability completely for specified outcomes, and limitation clauses that try to set a maximum on the amount of damages the party may have to pay if there is a failure of some part of the contract. Exemption clauses are regulated very strictly in consumer dealings but these don't apply for those who deal in the course of their business. From link above.
