Discussion

Jenny Mizrahi (asker) Jun 1, 2017:
To Frank: The text is indeed about a foreign judgement and the request is to execute this foreign judgement. My question was about בתובענה לגופה and I didn't understand how you propose to translate that particular term.
Frank Mayers Jun 1, 2017:
פסק חוץ is a foreign judgement. I have dealt with these cases myself as a lawyer. Take my word for it. Also the meaning in this context of לגופו is to " the merits " of the case. I agree that these are not literal translations but they are correct translations. Based on actual experience in such cases plus 25 years as a legal translator.

Civil claim, a (law) action, complaint, or proceeding in its own right

The appellant has asked, in light of the above, that there should be a ruling regarding the civil claim itself, which was to enforce a third party ruling.

The case may have involved other claims or requests, but this sentence is concentrating on one in particular.

See http://knowit.org.il/Uploads/Documents/26-02.pdf for an example of similar usage.
Example sentence:

לזו המתחייבת בניהול תובענה לגופה, בין שנסתיימה בפשרה ובין בהכרעה שיפוטית.

disagree Frank Mayers : I have to disagree with the above translation. This is a reference to an application for the enforcement of a foreign judgement. I would render the sentence as filliws: a requested that in light of the above said a judgement be given on the merits of the

Frank, the term חוץ means external, not foreign. Furthermore, merits were not mentioned.
