I am updating an old translation. I came upon the following French with its English translation:
Afin de lui permettre d?importer le Produit, dans le cas où il ne serait pas fabriqué sur le territoire français, le PROMOTEUR fournira à XYZ une copie de la première page de la lettre d?intention adressée aux autorités de santé, à défaut, l?avis du comité consultatif de protection des personnes dans la recherche biomédicale (CCPPRB) ou, si cet avis n?a pas encore été donné, l?avis de réception par le CCPPRB du projet de recherche biomédicale (Art R.5142-14 du Code de la Santé Publique).

In order to make it possible to import the Product, in the case that it is not manufactured on French territory, the SPONSOR shall provide XYZ with a copy of the first page of the letter of intent addressed to the health authorities, in the absence of the opinion of the Review Board on the Protection of Human Biomedical Research Subjects (CCPPRB) or, if this opinion has not yet been given, the acknowledgment of receipt by the CCPPRB of the biomedical research project (Art R.5142-14 of the Public Health Code).
Am I correct in thinking that this translation is wrong? I think the meaning is that in the absence of a copy of the first page of the letter of intent, the opinion of the Review Board is to be provided. In other words "à défaut" refers to the letter of intent, NOT the opinion. Is this correct?

what is the purpose?

I can't argue with your language logic, but if the purpose here is related to public health, it would make more sense to accept a copy of the letter of intent only if the opinion of the Review Board is unavailable. Absent that, the Board's acknowledgement of receipt would likely be preferable to the letter of intent. If you have access to the code reference, that might solve the riddle.
