I had used "haciendo caso omiso", but I'm not sure if that reflects the recklessnes that the sentence talks about.

I don't think that the person "hace caso omiso". I think it refers to the person who doesn't take the minimun action to know the condition of the other person (in this case ilegal). In a more Creole fation it would be like "hacerse de la vista gorda" or "turn the blind eye"
