An individual who fails to survive the decedent by 120 hours is considered to have predeceased the decedent for purposes of homestead allowance, exempt property, and intestate succession, and the decedent's heirs are determined accordingly.

First, it’s helpful to get some definitions straight. A “homestead,” legally speaking, refers to one’s primary residence. You might have a house and cottage in Michigan and perhaps a condo in another state where you spend the cold weather months. It is possible to have multiple residences, but only one primary residence, or homestead.

Is the Homestead Exemption the Same as the Michigan Homestead Allowance?

They sound similar, but the Michigan homestead exemption and the Michigan homestead allowance are not the same thing. In Michigan, the surviving spouse of a deceased person (decedent) is entitled to claim a homestead allowance of an amount adjusted annually for inflation. In 2021, the homestead allowance amount is $24,000. If there is no surviving spouse, the allowance will be divided among the decedent’s surviving minor and dependent adult children.

The homestead allowance has priority over most other claims against a probate estate, with the exception of the costs of administering the estate and the decedent’s reasonable funeral and burial expenses. Priority means that if there are not enough assets in the estate to pay all claims, a claim with priority (such as the homestead allowance) will be paid before other claims.

The homestead allowance is paid to a surviving spouse or minor/dependent children in addition to any share of the estate to which they were entitled under the decedent’s will or Michigan law.

Homestead Allowance

A surviving spouse of the decedent is entitled to a homestead allowance of $15,000* (adjusted to $24,000 as of 2020, as provided in section 1210). If there is no surviving spouse, the decedent’s minor and dependent adult children may share the amount of the allowance, divided equally. 

The homestead allowance is exempt from and has priority of other claims against the estate, except administration costs and expenses and reasonable funeral and burial expenses. Broadly speaking, the homestead allowance is payable in addition to any share of the estate that passes to the surviving spouse or minor or dependent children by the will of the decedent, intestate succession, or elective share.

What is a homestead?

Your homestead is the place where you have your permanent home. It is the place to which you plan to return whenever you go away. You must be the owner and occupant or be contracted to pay rent and occupy the dwelling. You can only have one homestead at a time. Cottages, second homes, property you own and rent/lease to others, and college dormitories do not qualify as a homestead.

When someone passes away, their assets are to be distributed. It doesn’t matter if it’s testate or intestate, monetary or physical assets. Everything associated with the estate will be properly distributed. In addition, creditors will be able to make claims on the decedent’s estate. However, a surviving spouse and his or her children are entitled to be allowed property that is part of the estate before the distribution and creditor claims are settled. With the Selection of Homestead Allowance and Exempt Property form, the spouse and children have the rights to be granted allowance to the property and make some exempt from creditors.

An amount of property, worth up to $27,000, payable to the surviving spouse of the person who died, if any. If the person did not leave a spouse, this amount is divided equally between all of the person's minor children and dependent children (even if adults). If the person did not have any minor or dependent children, then the Personal Representative does not have to pay this Allowance.

The spouse (or children) can usually choose the property that makes up the Homestead Allowance, including cash, real property, personal property or any combination. But they cannot choose property that is left specifically to someone else under the Will unless the estate does not have enough other property. Property that is not money is valued as of the date it is transferred. The Homestead Allowance passes free from creditor claims against the estate.

The Homestead Allowance

15-2-402. HOMESTEAD ALLOWANCE. The homestead allowance is exempt from and has priority over all claims against the estate except as hereinafter set forth. The homestead allowance is in addition to any share passing to the surviving spouse or minor or disabled child by the will of the decedent unless otherwise provided in the will, or by intestate succession, or by way of elective share. The amount of the homestead allowance shall be fifty thousand dollars ($50,000). The homestead allowance is not a right to claim ownership of, or succession to, any homestead owned by the decedent at the time of the decedent’s death but is only the right to claim the sum set forth above. The right to a homestead allowance is determined as follows:

(a) If there is a surviving spouse of the decedent, the surviving spouse shall be entitled to a homestead allowance.

(b) If there is no surviving spouse, and there are one (1) or more children under the age of twenty-one (21) years whom the decedent was obligated to support or children who were in fact being supported by the decedent and who are disabled, as provided in 42 U.S.C. section 1382c, then each such minor or disabled child is entitled to a portion of the homestead allowance in the amount of the homestead allowance divided by the number of such minor or disabled children entitled to receive the homestead allowance.

O: Prawo Florydy nie wymaga zapisania majątku w spadku określonym osobom, tak więc każda osoba może skutecznie przez testament całkowicie wydziedziczyć każdą osobę oprócz swojego małżonka. Małżonek osoby zmarłej ma zawsze prawo domagać się 30 procent wartości majątku zmarłego jako tzw. „elective share” (prawo do zachowku). Dodatkowo, jeżeli jesteś małżonkiem lub dzieckiem osoby zmarłej, która nie pozostawiła Ci nic w testamencie, możesz mieć pewne dodatkowe prawa zabezpieczające Cię przed całkowitym wydziedziczeniem. Np. jako małżonek na Florydzie możesz mieć również prawo do nieruchomości zmarłego, zakwalifikowanej jako „homestead”. Dzieci i małżonek zmarłego mogą mieć również prawo do tzw. „family allowance”, czyli przydziału rodzinnego do maksymalnej kwoty $ 18,000.00 wypłacanej przed ostatecznym podziałem majątku pomiędzy spadkobierców. Niektóre stany nie uznają małżeńskiej wspólnoty majątkowej a niektóre z nich proponują alternatywne rozwiązanie w postaci wyodrębnienia tzw. siedliska lub inaczej miejsca zasiedzenia (homestead). Według tych przepisów mąż i żona, a nawet inni członkowie rodziny mogą zadeklarować dom, teren i ruchomości znajdujące się na terenie ich rodzinnej posiadłości jako jako tzw. siedlisko (homestead) zabezpieczając je w ten sposób przed wszelkimi roszczeniami wierzycieli. Zwykle wartość takiej rezydencji jest ograniczona do jakiejś konkretnej sumy. W niektórych stanach także dom stanowiący współdzierżawę (joint tenancy) może zostać uznany za tzw. siedlisko (homestead).

Przepisy dotyczące wyłączeń siedliska w odniesieniu do podatków lub roszczeń wierzycieli różnią sie zasadniczo w zależności od stanu.
