CAPITULO II - ACUMULACION DE PROCESOS
PROCEDENCIA
Art. 188. - Procederá la acumulación de procesos cuando hubiere sido admisible la acumulación subjetiva de acciones de conformidad con lo prescripto en el artículo 88 y, en general, siempre que la sentencia que haya de dictarse en uno de ellos pudiere producir efectos de cosa juzgada en otro u otros.
Se requerirá, además:
1) Que los procesos se encuentren en la misma instancia.
2) Que el juez a quien corresponda entender en los procesos acumulados sea competente por razón de la materia. A los efectos de este inciso no se considerarán distintas las materias civil y comercial.
3) Que puedan sustanciarse los mismos trámites. Sin embargo, podrán acumularse DOS (2) o más procesos de conocimiento, o DOS (2) o más procesos de ejecución sujetos a distintos trámites, cuando su acumulación resultare indispensable en razón de concurrir la circunstancia prevista en la última parte del primer párrafo. En tal caso, el juez determinará el procedimiento que corresponde imprimir al juicio acumulado.
4) Que el estado de las causas permita su sustanciación conjunta, sin producir demora perjudicial e injustificada en el trámite del o de los que estuvieren más avanzados.
`*****PRINCIPIO DE PREVENCION*****
Art. 189. - La acumulación se hará sobre el expediente en el que primero se hubiese notificado la demanda. Si los jueces intervinientes en los procesos tuvieren distinta competencia por razón del monto, la acumulación se hará sobre el de mayor cuantía.
MODO Y OPORTUNIDAD DE DISPONERSE
Art. 190. - La acumulación se ordenará de oficio, o a petición de parte formulada al contestar la demanda o, posteriormente, por incidente que podrá promoverse en cualquier instancia o etapa del proceso, hasta el momento de quedar en estado de sentencia, siempre que fuere admisible con arreglo a lo que dispone el artículo 188 inciso 4.
RESOLUCION DEL INCIDENTE
Art. 191. - El incidente podrá plantearse ante el juez que debe conocer en definitiva o ante el que debe remitir el expediente.
En el primer caso, el juez conferirá traslado a los otros litigantes, y si considerare fundada la petición solicitará el otro u otros expedientes, expresando los fundamentos de su pedido. Recibidos, dictará sin más trámite resolución, contra la cual no habrá recurso y la hará conocer a los juzgados donde tramitaban los procesos.
En el segundo caso, dará traslado a los otros litigantes, y si considerare procedente la acumulación remitirá el expediente al otro juez, o bien le pedirá la remisión del que tuviere en trámite, si entendiese que la acumulación debe efectuarse sobre el que se sustancia ante su juzgado, expresando los motivos en que se funda. En ambos supuestos la resolución será inapelable.
Si se declarase improcedente el pedido, la resolución será apelable.
CONFLICTO DE ACUMULACION
Art. 192. - Sea que la acumulación se hubiese dispuesto a pedido de parte o de oficio, si el juez requerido no accediere, deberá elevar el expediente a la cámara que constituya su alzada; ésta, sin sustanciación alguna, resolverá en definitiva si la acumulación es procedente.
SUSPENSION DE TRAMITES
Art. 193. - El curso de todos los procesos se suspenderá, si tramitasen ante un mismo juez, desde que se promoviere la cuestión. Si tramitasen ante jueces distintos, desde que se comunicare el pedido de acumulación al juez respectivo. Exceptúanse las medidas o diligencias de cuya omisión pudiere resultar perjuicio.
SENTENCIA UNICA
Art. 194. - Los procesos acumulados se sustanciarán y fallarán conjuntamente, pero si el trámite resultare dificultoso por la naturaleza de las cuestiones planteadas, podrá el juez disponer, sin recurso, que cada proceso se sustancie por separado, dictando una sola sentencia.

En la explicación acerca de los límites de la jurisdicción, en especial de las personas, explicamos cómo se ejerce la misma cuando existen varias personas participantes de la infracción y que estos a su vez gozan de fuero. En palabras simples se puede colegir que será competente el Tribunal más alto de los que gocen los intervinientes en la infracción y si todos son de la misma categoría entonces se aplicara el **principio de prevención de la causa** para radicar la competencia.

Hi Taña, I too have found references to the phrase in the context of the environment. However, article 189 makes reference to the first instance having jurisdiction over a matter. I think Adrian is on the right track.

Based on a dictionary search in monolingual and bilingual dictionaries, I believe prevención has to do in the first instance with the concept of "jurisdiction" and the principles surrounding it.

Doctrine of the Court First Seised (of the matter)

Court first seised of the matter, meaning dealing with the case in an 'accumulation' = joinder of multiple actions, rather than seized in the sense of overrun by prtotesters (sounds daft, but there is a DEU/ENG answer on ProZ referring to seis/zed (owner) of land in fee simple and claims the property has been confiscated).

Funnily enough and dovetailing with the other question, ties up with the doctrine of lis alibi pendens (defenc/se or plea that the case is pending in litigation elsewhere).

Prevención 'being the first court to hear a case (Butterworths). thus *pre-empting the jurisdiction of other courts' (West).
Example sentence:

The Article provides for the court first seised to have priority in the same cause of action between the same parties.

Establishment of jurisdiction of the court first seised by reason of appearance being entered without objection by the parties or the adoption of a final judgment.

Thanks, Lester. I like the idea of the '(court) first-seised rule'. About the only permutation that might not work is a 'maxim' e.g. a Maxim of Equity_ 's/he who comes to Equity must come with (topically) clean hands'.

Parallel and competing proceedings between international courts and tribunals,
just as between international and domestic tribunals, is not a new phenomenon but
certainly one that is gaining in recurrence. This is turn is the inevitable consequence of
the proliferation of international courts and tribunals, on the one hand, and the lack of
appropriate legal rules to deal with the matter, on the other hand. While there is little
that can be done at present about the proliferation issue, there is much than can be done
in respect of the governing legal principles and rules.

The common law doctrine of forum non–conveniens has proven to be an
effective supplementary approach to this question. As a recent resolution of the Institut
de Droit International on the principles governing this doctrine has stated, “Parallel
litigation in more than one country between the same, or related, parties in relation to
the same, or related, issues may lead to injustice, delay, increased expense, and
inconsistent decisions”. As it is a shared understanding that these negative
consequences must be avoided, forum non–conveniens has been gaining international
acceptability, although many times the same objectives have been achieved under
doctrines of abus de droit, closer to civil law jurisdictions, and lis pendens when applied
as a general principle of law.

Forum non conveniens (Latin for "forum not agreeing") (FNC) is a (mostly) common law legal doctrine whereby courts may refuse to take jurisdiction over matters where there is a more appropriate forum available to the parties. As a doctrine of the conflict of laws, forum non conveniens applies between courts in different countries and between courts in different jurisdictions in the same country. Forum non conveniens is not applicable between counties or federal districts within a state. A concern often raised in applications of the doctrine is forum shopping, or picking a court merely to gain an advantage in the proceeding. This concern is balanced against the public policy of deferring to a plaintiff's choice of venue in claims where there may be more than one appropriate jurisdiction. The underlying principles, such as basing respect given to foreign courts on reciprocal respect or comity, also apply in civil law systems in the form of the legal doctrine of lis alibi pendens.

See page 75 for Argentina: In Argentina there is no non-dscretionary rule that requires the courts to decline jurisdiction in cases involving a foreing choice of jurisdiction clause, except, as observed earlier, when some question relating to Argentine public order is involved.

Page 46: Argentinian law has a doctrine of litispendencia by connexity. This applies wehre one of the three elements (same parties, object, cause) for lis pendens (litispendencia by identy is missing). Under this rule, the Argentinian court will order the "accumulation of the proceedings".
