The Architect is obliged to remove defects within 7 calendar days. Not fulfilling this provision shall be treated as a material breach of the Agreement and shall be subject to the contractual penalty in accordance with § 15 section 1 item c.

§ 15.
1. The Principal may require from the Architect a payment of a contractual penalty:
a) for each day of the Architect’s delay up to 30 (thirty) days in proper execution of the Agreement or part thereof, for which a separate receipt deadline was set, in the amount of 0.1% of net of VAT Remuneration for respectively the entire Agreement (in case of improper execution of the Agreement) or a delayed stage (in case of improper execution of part i.e. stage of the Agreement);
b) for each subsequent day of the Architect’s delay in proper execution of the Agreement or thereof over 30 (thirty) days, the penalty shall be 0.2% of the net of VAT Remuneration for respectively the entire Agreement (in case of improper execution of the Agreement) or a delayed stage (in case of improper execution of part i.e. stage of the Agreement) ;
c) for termination of the Agreement by the Principal due to reasons for which the Architect is liable, the penalty shall be 10% (ten percent) of the net of VAT Remuneration.
