Yes, he was found fully responsible because, though he was collided, he was in the wrong way and made a completely reckless turn. The responsibility is complete and the lower court judgment was in favor of the plaintiff. Now, the defendant will try in the court of appeals to lower the quantities to pay for damages as they are trying to enforce on the claiming third parties the cap of insured amount (jurisprudence is on their favor but lower court ruled for the unenforceability of the contractual limit. So, coming back to your question yes, the liability is there but the way it is phrased doesn't allow me to put "liability: at fault" as suggested (as responsabilidad: comprometida) because it doesn't make sense...

Was any responsibility assigned to the other driver? I have not been able to find any definition of "responsabilidad comprometida" but to me it does not seem to be saying that he is fully liable but his actions are what in the US is known as contributory negligence

Hi! I have read the link. It could be that I put Liability: At fault. The problem that I see is that in what you posted it says that if you are collided, you can not be "at fault" and this guy, although he is liable (as it was in the wrong way and got in the way of the other woman that had the right of way) was collided by this woman. The lower court judgment and experts reports decided that his liability was "comprometida", so, can I put "at fault" although he was collided?

No entendi bien. O sea en el apartado que dice "liability", en vez de comprometida poner "at fault". no me cierra. Se entiende que es un cuadro?

Estimado: es bien sintético. Como mencioné se determina que la responsabilidad está comprometida, en el sentido de que es responsable de este accidente. Pero la terminología es suscinta; es un cuadro en el que aparece: Evaluacion responsabilidad. Responsabilidad: Comprometida. Tiene seguro: si. Franquicia, etc etc etc. No más contexto que ése.
