French to English Bus/Financial Law: Contract(s) facilities classified for environmental protection
Contexte:

I actually cannot make out what this means what "rights of the building complex" are referred to here?

Your expert help would be very much appreciated!

Discussion

Nikki Scott-Despaigne Jun 25, 2018:
@Cassandra Following on from what AT has suggested. This knowledge can be gained but wherever you see reference to anything vaguely official, it is necessary to refer to that source. Official sources sometimes have official EN versions, although the quality is sometimes horrendous. Your client may wish you to follow such official translations regardless. Most of all, the official sources provide the key context. You no doubt know where to track that info down but when it's in the source document, I consider it compuslory to check it out. ;-)
AllegroTrans Jun 24, 2018:
A proper undertsanding of all this... involves knowledge of the French property transaction system - i.e. the stages in preparation of a contract, the searches that need to be made, the technical reports that have to be obtained, and the cadastre and land registry procedures.
Cassandra Delacote (asker) Jun 24, 2018:
Thank you Germaine, your input seems very logical. It does make it so difficult to determine which is the true meaning though! I will look up the site as you suggest.
Daryo Jun 24, 2018:
@ AllegroTrans these seems to be two new freshly created databases [Directive n°2010/75/UE du 24/11/2010] that are separate from any Land registry / Cadastre - the cross-referencing/search is by location - and obviously it will have or not some impact on the corresponding title.
AllegroTrans Jun 24, 2018:
Agree with Germaine that "droits de l’Ensemble Immobilier" probably means nothing more than "title to the building development". In the context I imagine it is saying that no "listed installation" is referred to in the title documents and/or searches such as the Land Registry. the Prefectorate etc.
Germaine Jun 23, 2018:

Selected

[some potential obstacle] linked to / referenced to this location / to this property

"aux droits de ..." = version désuète de "aux endroits des ..."

That's what makes sense, also confirmed by CNRTL [Centre National de Ressources Textuelles et Lexicales]

as it is often the case, to understand legalese you have to dig into the archaeological layers of language:

3. Comme il faut, régulier.
a) Loc. adv.

the use of the plural would make sense for "un Ensemble Immobilier" i.e. a large area with many lots/locations where you could have to deal with "listed buildings" / "contaminated soil" and other assorted sources of annoyance for developers.

Note from asker:
Wow Daryo! That is awesome, I could never have discovered that without your help! Thank you so much for the explanations, references and suggested translation. I am really impressed!
You also made a comment as to the expression "projet de vente" and disagreed on the proposed translation "Draft Sales Agreement". Could you possibly also make a suggestion as to the correct translation in that context. I had used Preliminary contract of sale"/"Sale Pre-Contract Agreement" appended to the undertaking to sell. What do you think?
Peer comment(s):

yes, it's not perfect - you can look at the two searches/registers in question and make an alternative interpretation that makes sense as a whole ...
neutral AllegroTrans : could it simply mean ownership/title?

4 KudoZ points awarded for this answer. Comment: "Thank you for this answer which, after much hesitation, I eventually used as it fitted with the context and another section where it appeared again. I am also very grateful to Germaine for her input which I am sure is correct, but I eventually had to make a choice! "
