Hi all -

In translating a legal document concerning corporate bankruptcy and what ultimately happens to the assets of the bankrupt company, I am not sure how to best translate this phrase:
configurare una distrazione dell’attivo

Here's the context (I capitalized the phrase here - it isn't in the original.)
Una spiegazione ulteriore di quanto ho appena descritto può essere rintracciata nel fatto che la revoca di una cessione o di una licenza di marchio o di brevetto può produrre effetti dirompenti sull’organizzazione del cessionario o del licenziatario, senza giovare al fallimento, che non può sfruttare direttamente il bene (salvo l’esercizio provvisorio) e può aver difficoltà a reperire un altro interessato all’acquisto dello stesso. Si deve considerare la circostanza che le tecnologie brevettate e perfino i marchi possono essere sfruttati più efficacemente da chi li conosce bene e che il primo interessato al loro acquisto e chi li usa da un tempo sufficiente per essersi familiarizzato con loro (in materia si v. FORMIGGINI, 1114-1115).

Può comunque accadere che, in certe situazioni, si possa CONFIGURARE UNA DISTRAZIONE DELL’ATTIVO, di rilevanza penale. La cosa merita una specifica menzione perchè il valore dei beni immateriali non è facilmente determinabile in modo obiettivo (FORMIGGINI, 1114).
