En los casos alcanzados por el artículo 2° del citado Decreto, deberá consignarse la vinculación exclusivamente en relación a los procedimientos en los que el funcionario de rango inferior a ministro tenga competencia o capacidad para decidir sobre la contratación o acto que interese al declarante. La omisión en la declaración de este vínculo no será considerada falsa cuando aquéllos no tengan competencia o capacidad para el dictado del acto definitivo que interese al declarante.
