I am deeply confused by this sentence:

Treffen die Vertragsteile keine der Schriftform entsprechende abweichende Bestim­mung, so ist die Flächenfestlegung auch bei der Umlage der Mietnebenkosten heran­ zuziehen, sofern diese nach Flachenanteilen erfolgt.

My suggestion:

If the contracting parties fail to comply with the corresponding provision deviating from the written form requirement, the surface area specifications must be used even when apportioning incidental rental expenses, provided that this occurs according to proportion of available space.

Is there a ST mistake in the first clause?

agree otherwise in writing Something along the lines of "if the Parties don't agree otherwise in writing". "Eine Bestimmung treffen" means to agree on a clause. The source text is perfectly intelligible to me.

It's not easy, is it? It's parsed as follows:

Treffen die Vertragsteile keine abweichende Bestimmung = Unless the parties agree otherwise
Der Schriftform entsprechend = in writing.

Already in the glossaries, but this answer can be included as a discrete - so self-contained - alternative.

Unless the parties *hereto* make a different arrangement (in an opt-out) that is reduced to writing....

NB one UK legal client objected to the phrase of being 'reduced or consigned to to writing' instead of being made in writing. The trans. agency in point: 'the client is always right'.
