I am deeply confused by this sentence:
Treffen die Vertragsteile keine der Schriftform entsprechende abweichende Bestimmung, so ist die Flächenfestlegung auch bei der Umlage der Mietnebenkosten heran zuziehen, sofern diese nach Flachenanteilen erfolgt.
My suggestion:
If the contracting parties fail to comply with the corresponding provision deviating from the written form requirement, the surface area specifications must be used even when apportioning incidental rental expenses, provided that this occurs according to proportion of available space.
Is there a ST mistake in the first clause?

NB one UK legal client objected to the phrase of being 'reduced or consigned to to writing' instead of being made in writing. The trans. agency in point: 'the client is always right'.
