French term

prévention

French to English Law/Patents Law (general) the term in question is used in a legal document -- order by a judge
This word is used innumerable times in this lengthy order/opinion by an examining magistrate in France, in a case involving a number of terrorists who were arrested for attempted attacks. One longer example is this:

Attendu qu’il y a lieu de rectifier la date des faits de la prévention A.6. a) à f) de la cause I. en ce sens que ceux-ci ont été commis entre le 29 août 1999 et le 18 octobre 2000 et non entre le 29 août et le 18 octobre 2000 comme indiqué par suite d’une erreur matérielle à la citation;

I am thinking that "prévention" could not be an order for preventive detention, although that is the dictionary meaning assigned to it (see:

http://www.larousse.fr/dictionnaires/francais-anglais/préven...

Could it mean "charge" or "charges". It doesn't make sense to me that orders for preventive detention would be itemized in this way (by letter and number). It makes more sense to think of the term here as referred to the various sets of charges (and subsets).

Any idea?

Thank you!

Discussion

Patti Maselli Nov 26, 2014:
It is on the basis of an indictment that an accused person must stand trial.

An indictment will state the relevant alleged facts and set out the nature of the alleged crime.

So maybe: the facts set out in the indictment.......

Thank you all for the excellent source documents, but I have a related question about a term that was mentioned by Liz Askew. Could "chef de prévention" mean "lead charge", as in primary charge? You indicate that it might be "count", which is defined in the U.S. as "each separate statement in a complaint which states a cause of action which, standing alone, would give rise to a lawsuit), or each separate charge in a criminal action." In that sense, "prévention" could mean "count". What do you think?
Patti Maselli Nov 26, 2014:
A suggestion.... I am away from my desk, but you could perhaps look at "indictment" or "committal for trial" as possibilities.

Offense (US), Offence (UK)

An offense is the fact of breaking the law whereas a charge is the fact of being accused of an offense

detention/taking into custody

This is how I would translate : la date des faits de la prévention .......en ce sens que ceux-ci ont été commis

the date of taking into custody(arrest)
the date of facts that lead to detention

Hope it will be useful.Good luck!
