I have used "third party error" for the first part, but I cannot find what the English uses in relation to the victim part of this here. I do not understand what it is.

: Essential to translate "faute" as "fault" NOT "error" or "responsibility". As dleu notes in the Discussion, "injured party" may be more appropriate than "victim".

: As A/T says, in this sort of situation, it is better to stay with 'fault', which can't be wrong; 'for which... is responsible' might be a possible solution, but would need rewording from your suggestion.
