判刑預表/告 Explanation: I think you might have already known about the meaning and the procedure of this kind of plea bargain, but I quoted it anyway from the CPS of UK as follows: Judges sometimes give an indication to trial advocates of their view of the acceptability of pleas if they were to be offered. As a result of adverse comment in the case of Attorney General's Reference (No. 34 of 2010) (R v Simon Roland Langridge) [2010] EWCA Crim 2055, guidance has been issued that, where a judge wishes to indicate to the advocates his or her views of the viability of the case or the acceptability of pleas, this should be done in open court with a full recording of proceedings, in the absence of the jury but with both sides represented and the defendant present. Reporting restrictions can be applied in order to safeguard a situation where the indication is not accepted and the matter proceeds to trial. The procedure set down for sentence indication in R v Goodyear [2005] EWCA Crim 888 provides a suitable model for such discussions. I suggest to use 預表/告 = 預先表明 的意思, because it implies something you will be told in advance of your plea of guilty or no contest. 供參考。 Reference: http://www.cps.gov.uk/legal/s_to_u/sentencing_-_general_prin... |
