Late Documentation Fee

In order to comply with U.S. Census Bureau / U.S. Customs regulations governing the use of the Automated Export System (AES) pre-filing for U.S. Export cargo documentation, XXXX must employ a strict “No Doc No Load” policy which includes a ***Late Documentation Fee***.

Documentation Charge - Late Documentation Fee (LDF):

ICL strives to process and release all Full Container Load (FCL) Bills of Lading (B/Ls) in an accurate and timely manner with the vast majority of B/Ls being released within one business day of vessel sailing.

In order to maintain this standard and comply with current manifest filing regulations, it is necessary for our Documentation Department to receive complete master bills of lading with full cargo declaration (in addition to Shipper’s Export Declarations (SEDs), AES exemption legends or AES proof of filing citations) prior to vessel loading.

We may roll cargo for which complete information as described above has not been received prior to vessel loading, especially for parties who are deemed repeat late documentation offenders. Cargo rolled due to late or incomplete documentation will be subject to Export Demurrage as per applicable tariff.

ICL will assess a Late Documentation Fee (LDF) on any shipments whereby the above documentation was not received prior to actual vessel sailing.

This fee will be added to the ocean bill of lading as a prepaid charge as follows:
Documents received after vessel sailing but prior to 5 p.m. EST/EDT on Business Day 1, LDF = $50
Documents received prior to 5 p.m. EST/EDT on Business Day 2, LDF = $100
Documents received prior to 5 p.m. EST/EDT on Business Day 3, LDF = $250
Documents received after 5 p.m. EST/EDT on Business Day 3 will be assessed an additional $250 per calendar day up to and including the day of receipt.

Shipper will also be held responsible for any and all Customs penalties assessed due to late, incomplete or inaccurate documentation.

It is in our mutual interest to ensure timely exchange of all relevant shipment information. We hope you understand the necessity of all customers taking adequate actions to submit their information in a timely manner and ICL’s efforts to enforce timely submission.
