Hallo zusammen,

Kontext: Geheimhaltungsvereinbarung, die ein Unternehmen aus der Medizinbranche seine Angestellten unterzeichnen lässt. Im Anhang zu diesem Werk ist ein so genanntes "Termination Certificate", das die Angestellten nach Beendigung des Arbeitsverhältnisses unterzeichnen müssen. Darin bestätigen sie u. a., dass sie keine vertraulichen Informationen preisgeben und keine Mitarbeiter ihres (früheren) Arbeitgebers abwerben dürfen. Außerdem heißt es wie folgt:

"Further, for a period of twenty-four (24) months from the date of this Certificate, I ***shall not solicit*** any licensor to or customer of the Company or licensee of the Company’s products, in each case, that are known to me, with respect to any business, products or services that are competitive to the products or services offered by the Company or under development as of the date of termination of my Relationship with the Company."

Bin mir hier nicht 100% sicher, wie die Verbform zu verstehen ist. Ist hier gemeint, dass der Angestellte 24 Monate nach seinem Ausscheiden aus dem Unternehmen keine Produkte/Dienste von Wettbewerbern seines früheren AG in Anspruch nehmen/anfordern darf?

agree  David Moore (X): To me, the "approach, contact" aspect is every bit as important as the "abwerben" idea, as it includes products of all sorts, whereas you cannot "abwerben" a product.
