GUIDELINE
FAIL TO SURRENDER TO BAIL
A. Statutory provision
1. Section 6 of the Bail Act 1976 states:
“1) If a person who has been released on bail in criminal proceedings fails without reasonable cause to surrender to custody he shall be guilty of an offence; and
2) If a person who:
(a)
has been released on bail in criminal proceedings, and
(b)
having reasonable cause therefor, has failed to surrender to custody, fails to surrender to custody at the appointed place as soon after the appointed time as is reasonably practicable, he shall be guilty of an offence.”
2. An offence under subsection (1) or (2) is punishable either on summary conviction or, in the Crown Court, as if it were a criminal contempt of court. The maximum sentence in a magistrates’ court is 3 months imprisonment.1 If the matter is committed to the Crown Court for sentence, or dealt with there, the maximum sentence is 12 months custody and the sentence is subject to the usual appellate procedures.

"Bail Offences
If you are released on police bail and do not return on the date and at the time required, you may be charged with a separate criminal offence. This is called ‘failure to surrender’ and whilst you may not think that the actual penalty given for this offence is particularly serious, it does count as a ‘breach of trust’. Breaches of trust on a person’s criminal record may affect your ability to get bail if you are ever charged with an offence in the future."

Chtělo by to anglického právníka, ale podle neexistuje v UK žádný přečin/trestný čin, který by se jmenoval Fail to Surrender ve smyslu neuposlechnutí policejní výzvy ke vzdání se. Takové neuposlechnutí IMO spadá pod Sec. 82 of Police Act 1996 Assaults on constables (v US je to Disobeying a Police Officer). <br><br>Kromě toho je 28 August 2011 datum, kdy byl offender přistižen, nikoli odkdy v enclosed premises pobýval. Vyplývá to z úpravy tohoto přečinu/tr. činu ve Vagrancy Act 1824 (...every person being found in or upon...) . Takže první přečin/trestný čin s druhým podle mne nesouvisí.<br><br>Fail to Surrender je podle mého názoru tedy zkrácenou verzí Fail to Surrender to Custody a souvisí s podmínečným propuštěním, viz např. zde: http://www.gazetteherald.co.uk/news/9756657.print/

Myslím, že "neuposlechnutí nařízení" to také vystihuje.nebo "opomenutí podrobit se", ale i "vyhýbání se úkonům", což už ale předjímá víe kontextu.

zajimavy problem - na netu fail to surrender nachazim hlavne v souvislosti s driver's license nebo jinymi papiry (insurance) (neboli jizda bez dokumentu, hlavne v Kanade), takze by stalo za to zkusit nechat upresnit, co se tim vlastne mysli. Napadlo mne taky, ze by se mohlo jednat o nevzdani se, ve vyznamu ze cloveka honi policajti a on po vyzve stuj, nebo te zastrelime (haha) bere nohy na ramena
