Cat timp persoana este retinuta pentru continuarea cercetarilor, aceasta stare de arest este "preventiva", de unde si denumirea de "arest preventiv", adica din diverse motive autoritatile nu au incredere in persoana retinuta si doresc sa previna comiterea altor fapte asemenatoare sau care ar impiedica desfasurarea cercetarilor respective
