English term

waive

English to French Law/Patents Law: Contract(s) contrat d'achat
La phrase dans laquelle se trouve le terme est la suivante: "Purchaser waives and will furnish written evidence that insurers of Purchaser waive all rights of recourse and subrogation against Supplier"

Merci d'avance!

I would place a translator's note indicating the above just to cover yourself. When translating legal documents, there is no supposition. The document should be translated as such and you should indicate faulty language, thereby justifying your translation.

Thank you gsloane, this is very interesting to have the advice of an English speaker!

missing commas! This is a perfect example of a poorly written agreement where commas are of the utmost importance. The English text should have been written as follows:
Purchaser waives, and will furnish written evidence that insurers of Purchaser waive, all rights of recourse and subrogation against Supplier". Without the commas, it makes no sense in English and is subject to wide, and perhaps even, wrong, interpretation. Be very careful when translating legal agreements, especially if they are poorly written and subject to wide interpretation. This is particularly important if these legal agreements are going to be used in the litigation process in the event of a dispute. There is ample case law available where the comma has made or broken case law.

Merci, c'est ce que j'imaginais mais je voulais m'assurer qu'il n'y ait pas de particularité dans ce cas précis...

D'accord avec vous bohy.

waives n'est pas "tout seul" Purchaser waives, and insurers of Purchaser will waive, all rights of recourse...
Pour le traduire, il faut reconstruire la phrase : Purchaser waives all rights of recourse... and will furnish evidence that insurers of Purchaser will also waive all rights of recourse... imho

renonce, et s'assure que son assureur renonce aussi
Note from asker:
Donc je ne différencie pas selon que "waive" est suivi ou de "all rights"?
