From a study of the works of a legal scholar. There are very few hits in "Google" for the obvious "fact of cause". Any help appreciated.

"Per lo studio del diritto comparato è indispensabile, dunque, la conoscenza della giurisprudenza che è conoscenza anche del caso concreto che fonda la sentenza emanata. Poco importano per l’Autore le dogmatiche create da alcuni tribunali che afferiscono, come le teorie della dottrina, alla law in the books, contrapposta alla law in action che è il reale . Per conoscere effettivamente la law in action, occorrono alcuni strumenti imprescindibili, le raccolte di giurisprudenza che, perché possano assolvere al loro compito, devono necessariamente riportare il fatto di causa.
Questa è per l'Autore la principale lacuna delle raccolte giurisprudenziali italiane, che caratterizzate dagli omissis sul fatto e dalla presentazione della sentenza come spiegazione di una massima astratta e non come risoluzione di un caso concreto, non permettono un’effettiva conoscenza della giurisprudenza delle Corti di questo Paese. Egli pure ammette che il fatto concreto sul quale il giudice è chiamato a pronunciarsi, può venire tipizzato, perché possa divenire un precedente utilizzabile per casi futuri, ma la conoscenza del caso concreto deve essere comunque trasmessa, poiché rimane indispensabile."
