Der Lieferant hat im Schadensfall immer das Recht der Nachbesserung.

This is in an agreement laying out the terms and conditions of quality assurance management between a supplier and the client. The text in Austrian German and is for an Austrian client.

For the term "Nachbesserungspflicht," Dietl/Lorenz gives "(contractor's) obligation to remedy a defect (complained of)" with the context given as "Werkvertrag." Analogously, I think "(supplier's) right to remedy a defect" would work here. The source below also contains the phrase "cure a defect."

remedy of a defect is the English translation of Nachbesserung,

Falls die gelieferte Ware mangelhaft ist, kann der Lieferant den Mangel "ausbessern" im Sinne von beheben.

Üblicherweise spricht man aber davon, dass der Kunde das Recht auf Nachbesserung hat. Oder erhält in dem Fall der Lieferant eine Ware?

entitled to recify defects

In case of damanges the supplier is entitled to rectify defects. Laut Dietl/Lorenz Wörterbuch für Recht, Wirtschaft und Politik, "subsequent improvement" und "rectification of defects" Je nach Vertragsgegenstand könnte es auch noch mal "such damagages" statt "defects" sein. Wir nehmen für Softwareverträge meist "correct/resolve (suspected) defects"

Ich sehe gerade, dass ich (natürlich) aus der Sicht des Herstellers geantwortet habe. Bevor der Kunde irgenwelche Zahlungen nicht leistet, wollen wir natürlich eventuelle Fehler korrigieren.... Aus Sicht des Kundes heißt es normalerweise "Anspruch auf Nachbesserung". Sollte die Perspektive aus Kundensicht sein, hat Gudrun natürlich recht, bzw. in meiner Version dann "entitled to the rectification of defects"
