Legislative Accord 315 of 14 December 2006 declares that it is admissible the initiation of criminal complaint in the process of preliminary hearing against Deputy of the Central American Parliament who is suspended from his functions. (p. 4)

un antejuicio es siempre una vista previa para ver si se presentan cargos penales pero:

El antejuicio de mérito es un procedimiento especial establecido para proteger a los altos empleados públicos de acusaciones infundadas o temerarias que puedan perturbar indebidamente el cumplimiento de sus funciones. El ‘antejuicio’ debe determinar en forma expedita y simple la existencia o inexistencia de los ‘méritos’ para iniciar el juicio. La Constitución establece en su articulo 266 que la Sala Plena del Tribunal Supremo de Justicia es la competente para declarar si hay o no mérito para el enjuiciamiento de cualquiera de los Magistrados que la componen.
