ومعنى قولها: (ما لم يكن إثماً) أي ما لم يكن محرماً متفقاً على تحريمه، بدليل قولها في آخر الحديث: (إلا أَنْ تُنْتَهَكَ حُرْمَةُ اللَّهِ فَيَنْتَقِمَ لِلَّهِ بها). أي يقيم حدَّ الله، كحد السرقة والزنا وغيرها من الحدود.
أما الأحكام الفقهية المختلف فيها، بين الحل والحرمة، فهذا لا يصح وصف مرتكبها بأنه آثم، ولا يصح الإنكار على فاعلها بأنه آثم بفعلها.

yeah but the ruler has to enforce the law as to cut the hand for example he has to apply it there isn't another option if the conditions are there ...he can't say let's apply it to the poor and leave the rich...we all now the hadith "if Fatima daughter of Mohamed have robbed I'd have cut her hand myself"

neutral younes-01 : I think your suggestion though is reasonable, seems to me not accurate as there may exists cases where hodoud allah would not merely refer to punishment
