Ipoteca ce se întinde asupra tuturor amelioraţiunilor ulterioare constituirii ei, potrivit art. 1777 din Codul civil, va asigura preferinţa faţă de creditorii care au constituit o garanţie mobiliară asupra acestor amelioraţiuni, numai dacă ipoteca asupra amelioraţiunilor a fost înscrisă la arhivă, chiar dacă ipoteca a fost înregistrată în registrele de publicitate imobiliară.
