Pošto sam gotovo siguran da je reč o (2), mislim da bi justice ovde više odgovaralo, pošto equity ima uže značenje: "a fair and reasonable way of behaving towards people, so that everyone is treated equally: a political campaign for pay equity" (Macmillan Eng. Dict.). Dakle, equity označava pravednost u smislu pravične raspodele.

Justice je "treatment of people that is fair and morally right" ili "the fact that something is reasonable and fair": He appealed to their sense of justice" (Pozvao se na njihovo osećanje pravičnosti/pravednosti).

Justice is the broader of the two terms. It's an abstract ideal and what you expect to get from the law, and I think it fits best here especially because of the pravo-pravednost opposition. When a murderer walks out of a courtroom a free man because he wasn't read his rights by the arresting police officers, that may be ok in the eyes of the law, but where's the justice (not equity) in that?
