Italian term or phrase: sia... che

In einer Bürgschaftserklärung findet sich folgender Satz, der zwar keine unverständlichen Satzteile aufweist, dennoch in sich meiner Meinung nach unlogisch bzw. grammatikalisch nicht korrekt ist.
Schreibt man hier eine Anmerkung ? (oder stehe ich vielleicht doch völlig auf der Leitung ?)

La mancata sottoscrizione da parte della società di tutti i fogli, sia del presente atto *che il contratto sottoscritto* ai sensi dell'articolo 1352 CC che deve pervenirci a cura del beneficiario e, ove non si provveda, a cura del contraente entro 10 gg dal rilascio della presente, con la conseguenza che la fideiussione diventa dall'origine inefficace.

Die Nichtunterzeichnung der vorliegenden Urkunde hat also zur Folge, dass die Bürgschaft ungültig wird; wie verhält es sich aber mit dem Satzteil ab "che il contratto sottoscritto" - wie ist hier der logische Zusammenhang mit der Ungültigkeit der Bürgschaft ?

Explanation:
Meiner Meinung nach liegt da ein Grammatik- bzw. ein Tippfehler vor ... es müsste heißen:

sia del presente atto ... sia del contratto sottoscritto (oder che del ...)

dann wäre der Zusammenhang einigermaßen logisch ...

also sowohl dieser Urkunde als auch des unterzeichneten Vertrags ...
