In Bezug auf die restlichen Zahlungen beantragt die Konkursverwaltung Verzicht auf deren Anfechtung. Mit Datum vom 28. Dezember 2004 hat die ausseramtliche Konkursverwaltung zur Wahrung der am 31. Dezember 2004 ablaufenden Verwirkungsfrist hinsichtlich aller identifizierten Zahlungen den Friedensrichter angerufen. Am 7. März wurde die Weisung ausgestellt. Die Weisung ist innert drei Monaten seit deren Ausstellung beim zuständigen Gericht einzureichen, ansonsten der Anspruch verwirkt. *

In. NR III C3: L’eventuale richiesta riguardante Grant Thornton AG. Zurigo. Ragioni del credito: contestazione secondo l’Art. 285 ff. SchKG di diversi pagamenti della X AG alla Y AG prima dell’apertura del fallimento. Fino ad oggi è stato identificato un pagamento dell’ammontare di CHF ... Di questi pagamenti un totale di CHF ... sono stati contestati tramite l’amministrazione fallimentare. In riferimento ai rimanenti pagamenti l’amministrazione fallimentare applica la rinuncia della contestazione.
